Terms of Service

The rules for using Blindspot Report.

These terms are the agreement between you and Blindspot Report, Inc. for the use of blindspot.report. They cover what you can expect from the service, what we expect from you, and — importantly for a product built on automated analysis — what the service does not promise.

1.Agreement to these terms

By creating an account or using blindspot.report (the "Service"), you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it, and "you" means that organisation. If you do not agree, do not use the Service.

Our Privacy Policy is part of this agreement.

2.Your account

  • You must be at least 16 to hold an account, and you must give accurate registration details.
  • You are responsible for what happens under your account and for keeping your password secure. Tell us promptly if you think it has been compromised.
  • Do not share your login. Accounts are for one person; if your team needs access, talk to us about an organisation plan.
  • Personalised podcast feed URLs contain a token that identifies you. Treat them as confidential — publishing one is effectively sharing your account.

3.Plans, trials and payment

The Service has a free tier and a paid Individual plan. Payments are processed by Stripe; we never see or store your card details.

  • Free trial. A new account gets one month of the Individual plan free, with no card required. When the trial ends without a subscription, the account moves to the free tier, which keeps the daily briefing.
  • Price and billing. Individual costs $100 per month, billed monthly in advance through Stripe. If you subscribe during your free trial, billing starts when the trial ends, not on the day you subscribe.
  • Renewal and cancellation. Your subscription renews automatically each month until you cancel. You can cancel at any time in Profile › Billing, which opens Stripe's customer portal. Access continues to the end of the period you have already paid for.
  • Refunds. We do not refund partial billing periods, except where the law requires us to or as set out in the next paragraph.
  • Price changes. We will tell you by email in advance of any change to the price, and it will apply from a billing period after that notice. You can cancel before it takes effect.

Organisation plans are arranged directly with us by email at sales@blindspot.report, and their commercial terms — price, term, invoicing, renewal — are whatever the written order or agreement between us says. Where that agreement conflicts with these terms, that agreement governs.

Features available on the free tier may change. We will not remove a feature you are currently paying for during a paid term without offering a pro-rata refund for the remainder of that term.

4.Acceptable use

You agree not to:

  • Scrape, crawl, or bulk-extract the Service, or use automated means to access it other than through an interface we provide for that purpose.
  • Resell, sublicense, or redistribute the analysis as a competing dataset or product.
  • Circumvent rate limits, access controls, paywalls, or authentication.
  • Probe or attack the Service, or use it to distribute malware.
  • Misrepresent our output — including presenting automated classifications as human editorial judgement, or quoting a figure without the qualifications given alongside it.
  • Use the Service to harass anyone, or to break the law.

Reasonable, attributed quotation of our published figures in journalism, research and commentary is welcome and is not restricted by this section.

5.Podcast content and third-party rights

The Service analyses podcasts that their publishers have made publicly available. Those podcasts, their transcripts and their trademarks remain the property of their owners. We reproduce limited excerpts for analysis, commentary, criticism and reporting, with attribution to the source episode.

Nothing in the Service is an endorsement of, or affiliation with, any podcast, host, network or political position. A classification is a description of content, not a judgement about a person.

If you hold rights in content that appears here and want to raise an issue, contact press@blindspot.report.

6.What the analysis is — and is not

This is the most important section in these terms, so it is in plain language.

Political stance labels, topic classifications, rhetoric measures and every derived figure on the Service are produced by automated analysis, including large language models. They are statistical estimates. They are not human editorial judgements, they are not fact-checks, and they are not guaranteed to be correct for any individual episode, quote, show or figure.

  • Automated classification makes mistakes, and those mistakes are not evenly distributed.
  • Aggregate figures carry measurement error. Where we publish a confidence interval, the interval is part of the number — a point estimate quoted without it is being misused.
  • Some measures on the Service are explicitly marked as preliminary or not human-validated. Those labels mean what they say, and they travel with the number.
  • Coverage is limited to the podcasts and episodes we have processed. Absence of a topic in our data is not evidence of its absence from public debate.

You are responsible for exercising editorial judgement before relying on, publishing, or making a decision based on anything the Service outputs. Do not use it as the sole basis for a claim about a person or organisation.

7.Our intellectual property, and your licence

The Service — its software, design, and the analysis and aggregated datasets we produce — belongs to Blindspot Report, Inc.. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use it for your internal business or personal use, and to quote from it with attribution.

Feedback you send us is a gift: we may use it without obligation or compensation. You keep ownership of anything you supply to the Service, and grant us the licence we need to operate the Service for you.

8.Availability and changes

We aim to keep the Service running but do not promise uninterrupted availability. We may change, suspend or discontinue features, and we may run experimental or beta features that are less reliable and are provided as-is.

9.Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness or reliability of the analysis. Some jurisdictions do not allow certain disclaimers, in which case they do not apply to you.

10.Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or relating to the Service — including any decision made in reliance on its output.

Our total aggregate liability arising out of or relating to these terms will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US$100. Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.

11.Indemnity

If you are using the Service on behalf of an organisation, that organisation will indemnify us against third-party claims arising from its use of the Service in breach of these terms or of applicable law.

12.Suspension and termination

You may stop using the Service at any time and ask us to delete your account (see the Privacy Policy, §8). We may suspend or terminate access if you materially breach these terms, if your use puts the Service or other users at risk, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to put it right.

Sections that by their nature should survive termination — §§5–7 and §§9–13 — do.

13.Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in California, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.

14.Changes to these terms

We may update these terms. The "last updated" date at the top always reflects the current version, and for material changes we will give notice by email or in the product before they take effect. Continuing to use the Service after a change takes effect means you accept the updated terms.
